Who owns a pic and for how long? If you have a fling with the office intern and during the course of the fling she emails you pics (ranging from innocent to full nude) - is there a statue of limitations on how long she owns them before someone else is then free to do whatever they want with them? Say the pics are 10 years old now and she blew you off 8+ years ago without so much as "bye," does she still have any legal claim of ownership and could drag your ass into court if they ended up on a website in 2012? (even if you told the person you "got rid of them" 9 some years back but kept an archive copy in secret?)

Pretty sure she can still sue for defamation whenever, but almost no chance she would see them so id post anyway

Um, if she GAVE them to you, they are your property I'd assume. I'd agree with the defamation, but once they are out of her hands, she does not really have a say with what happens.

Legally, they are yours to do as you please once they have been given to you.

copyright currently stands at 70 years after the initial production of the original document, image, film, video, score or audio recording. This is only for the original. Aura Lee is out of copyright, however Elvis's Love Me Tender (same tune) is in copyright since the lyrics are original even though the music is not.
